Terms of service
Terms of Service
Effective date: September 4, 2026
These Terms of Service (the “Terms”) govern your access to and use of the online store, website, products, services, reservations, and related offerings provided by Yamamori & Jiou Jiu Shang, Inc., doing business as IN Sake Museum and/or Sake Museum Claremont (“IN Sake Museum,” “we,” “us,” or “our”). Our online store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer products and services to you.
By visiting our website, creating an account, placing an order, making a reservation, purchasing admission or event access, enrolling in a membership or subscription, or otherwise using our services, you agree to these Terms and to any additional policies or agreements referenced in them. If you do not agree, do not use the website or purchase our products or services.
1. Eligibility and Acceptance
You must be at least the age of majority in your state or jurisdiction of residence to create an account or make a purchase. If you permit a minor to use this website, you remain responsible for the minor’s activity and compliance with these Terms.
Alcohol may be purchased, received, picked up, or consumed only by persons who are at least 21 years old. Additional age, identification, and eligibility requirements are described in Section 8.
2. Our Online Store
We may modify, suspend, or discontinue any portion of the website, online store, product selection, service, program, or feature at any time, subject to applicable law. We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.
Shopify hosts our online store and processes certain information on our behalf. Your use of Shopify-supported features may also be subject to Shopify’s applicable terms and privacy practices.
3. Product and Service Information
We make reasonable efforts to describe and display our products and services accurately. However, colors, labels, packaging, bottle vintages, ingredients, artwork, exhibition materials, and other details may vary from photographs or descriptions. Display settings may also affect how products appear on your device.
All descriptions, prices, products, services, admissions, reservations, events, workshops, benefits, and promotions are subject to availability and may be changed or discontinued without notice. We reserve the right to limit quantities or sales to any person, household, geographic region, or jurisdiction where permitted by law.
We do not warrant that a product, service, event, exhibition, or experience will meet every individual expectation. Sake flavor profiles, food and beverage preferences, educational interpretations, and similar matters may be subjective.
4. Orders and Order Acceptance
Your submission of an order is an offer to purchase. An order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it. We may accept, decline, limit, or cancel an order for reasons including product unavailability, pricing or description errors, suspected fraud, payment issues, legal or regulatory restrictions, age-verification concerns, or limits on quantities.
If we cancel an order after payment has been captured, we will issue a refund for the canceled portion to the original payment method, subject to applicable law and the processing times of your financial institution.
You agree to provide current, complete, and accurate billing, contact, pickup, and account information. You are responsible for reviewing all order details before completing checkout and for promptly updating information needed to process or fulfill your order.
5. Prices, Taxes, and Payment
Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, fees, deposits, service charges, and other charges will be disclosed at or before checkout when required. Prices and promotions may differ between our online store, physical location, special events, third-party platforms, and other sales channels.
You authorize us and our payment processors to charge the payment method you provide for your order and any disclosed taxes or fees. You represent that you are authorized to use the payment method and that the information you provide is accurate.
If a pricing, typographical, or calculation error occurs, we may correct the error and cancel or adjust the affected order as permitted by law. We will notify you if additional payment or approval is required before fulfillment.
6. Store Pickup, Fulfillment, and Delivery
Available fulfillment methods and estimated timing are displayed during checkout or in the applicable product description. Unless a shipping or delivery option is expressly offered at checkout, the order is for pickup at our location:
IN Sake Museum
532 West First Street, Suite 209
Claremont, California 91711
Pickup dates and times are estimates and are not guaranteed. Please wait until you receive confirmation that your order is ready before traveling to the museum. You may be required to present the order confirmation, a matching government-issued photo identification, and the payment card used for purchase.
Alcohol orders will not be released to anyone under 21 years old or to anyone who cannot provide acceptable government-issued photo identification. We may also refuse release when required by law or when the recipient appears intoxicated.
You are responsible for picking up your order within the stated pickup window. Orders not collected within that period are subject to our Refund and Return Policy, the applicable product terms, and applicable law. Risk of loss and title transfer as provided by applicable law and the selected fulfillment method.
If shipping or local delivery is offered for a particular non-alcohol or legally eligible product, the specific costs, restrictions, estimated timelines, and carrier terms shown at checkout or in our Shipping Policy will apply. We do not guarantee carrier delivery dates and are not responsible for delays outside our reasonable control.
7. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and order cancellations are governed by our Refund and Return Policy, which is incorporated into these Terms. Certain items and services may be final sale or subject to special cancellation rules, including alcoholic beverages, perishable goods, opened products, admission tickets, reservations, workshops, certification programs, memberships, subscriptions, gift cards, and customized or limited-availability items.
If a product or service page displays terms that differ from the general Refund and Return Policy, the more specific disclosed terms apply to that purchase to the extent permitted by law.
8. Alcohol Products and Age Verification
Alcohol-related content and products are intended only for persons of legal drinking age. By purchasing an alcoholic product or registering for an alcohol-included tasting, you represent and warrant that:
- You are at least 21 years old;
- The information you provide is truthful and accurate;
- You will present valid government-issued photo identification when requested;
- You will not purchase alcohol for, transfer alcohol to, or permit pickup by a person under 21 years old; and
- Your purchase, receipt, possession, transportation, and use of alcohol comply with applicable law.
We may use lawful age-verification procedures and may refuse or cancel an alcohol transaction if age, identity, sobriety, payment authorization, or legal eligibility cannot be confirmed. Refusal required by law or based on a failed age check does not entitle the purchaser to avoid otherwise applicable cancellation or restocking terms, except where the law requires otherwise.
Alcohol consumption is optional. Where stated, an eligible non-alcoholic alternative may be available. Guests must consume responsibly and arrange safe transportation. We do not provide medical advice regarding alcohol consumption, allergies, medication interactions, pregnancy, or health conditions.
9. Museum Admission, Tastings, Workshops, Events, and Certifications
Admission, tasting, workshop, event, and certification purchases may be subject to date, time, capacity, eligibility, identification, attendance, late-arrival, cancellation, rescheduling, and no-show requirements displayed on the applicable page or confirmation. Those requirements form part of your agreement with us.
Participants must follow staff instructions and applicable health, safety, alcohol-service, accessibility, and conduct rules. We may refuse entry or remove a person who creates a safety risk, disrupts the experience, harasses others, damages property, violates these Terms, or fails to satisfy an applicable age or identification requirement. Any refund will be determined under the applicable purchase terms and law.
We may make reasonable changes to instructors, presenters, pairings, featured products, schedules, exhibition content, or program details. If we cancel or materially reschedule a paid program, we will provide the remedy stated in the applicable event terms or otherwise required by law.
10. Memberships, Subscriptions, and Sake Club Plans
A recurring membership, subscription, or Sake Club plan is governed by the specific membership or subscription agreement and disclosures presented before purchase, including the price, billing frequency, minimum commitment if any, renewal terms, benefits, pickup requirements, cancellation method, and effective date of cancellation. Those plan-specific terms are incorporated into these Terms.
In the event of a conflict involving recurring billing, renewal, cancellation, or plan benefits, the applicable membership or subscription agreement controls. Our general Terms continue to apply to matters not addressed by that agreement.
You authorize recurring charges only when you affirmatively enroll in a recurring plan and accept its disclosed terms. You are responsible for maintaining a valid payment method and accurate contact information. Cancellation requests must be submitted using a method described in the applicable plan agreement or subscription policy.
11. Promotions, Discounts, Coupons, and Gift Cards
Promotions, discount codes, member benefits, coupons, credits, and gift cards are subject to their stated terms, expiration dates, eligibility rules, exclusions, and applicable law. Unless expressly stated otherwise, offers cannot be combined, transferred, redeemed for cash, applied retroactively, or used toward taxes, gratuities, fees, excluded products, or prior purchases.
We may reject or cancel the unauthorized, fraudulent, mistaken, or ineligible use of a promotion or benefit. Gift cards and store credits are also subject to applicable gift-card terms and law.
12. Accounts and Account Security
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate an account that is used fraudulently, unlawfully, abusively, or in violation of these Terms.
You may not create an account using false information, impersonate another person, or use another person’s payment method or personal information without authorization.
13. Acceptable Use
You may not use the website, store, or services:
- For any unlawful, fraudulent, deceptive, abusive, or harmful purpose;
- To violate intellectual-property, privacy, publicity, consumer-protection, or other rights;
- To transmit malware, malicious code, or harmful content;
- To scrape, crawl, copy, reverse engineer, interfere with, or circumvent the website or its security features except as permitted by law;
- To submit false information, fraudulent orders, unauthorized payment information, or misleading reviews;
- To harass, threaten, discriminate against, or harm any person; or
- To purchase or facilitate the purchase of alcohol for a person under 21 years old.
We may restrict or terminate access for violations of this section.
14. Intellectual Property
The website and its content, including text, photographs, graphics, logos, artwork, exhibition materials, audio, video, design, and software, are owned by or licensed to us and are protected by applicable intellectual-property laws. You may access the content for personal, noncommercial use only.
You may not reproduce, distribute, modify, publicly display, sell, license, exploit, or create derivative works from our content without prior written permission, except where applicable law expressly permits otherwise. Nothing in these Terms grants you ownership of or a license to any trademark, trade name, logo, or other brand identifier.
15. Reviews, Feedback, and User Submissions
If you submit a review, photograph, comment, suggestion, or other content to us, you represent that you have the right to submit it and that it does not violate law or another person’s rights. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, publish, translate, and display that submission in connection with our business and services, subject to applicable law and our Privacy Policy.
We may remove user content that we reasonably believe is unlawful, infringing, deceptive, abusive, irrelevant, or otherwise inappropriate. We are not obligated to publish or respond to submissions.
16. Third-Party Services and Links
The website may contain links to or integrations with third-party services, including Shopify, payment processors, reservation platforms, subscription applications, social-media services, maps, and delivery providers. Third parties operate under their own terms and privacy policies. We are not responsible for third-party websites, systems, content, acts, omissions, or service interruptions, except to the extent responsibility cannot lawfully be excluded.
17. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the website or providing personal information, you acknowledge the practices described in that policy.
18. Disclaimers
To the fullest extent permitted by law, the website, content, products, and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the website or services will be uninterrupted, secure, timely, or error-free, or that information will always be complete or accurate. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
19. Limitation of Liability
To the fullest extent permitted by law, Yamamori & Jiou Jiu Shang, Inc., IN Sake Museum, and their officers, directors, employees, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the website, products, services, events, or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our aggregate liability arising from or relating to a particular order, product, service, event, or transaction will not exceed the amount you paid to us for that order, product, service, event, or transaction.
These limitations do not apply to liability that cannot lawfully be limited or excluded, including any rights or remedies available to you under applicable consumer-protection law.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Yamamori & Jiou Jiu Shang, Inc., IN Sake Museum, and their officers, directors, employees, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website or services, your violation of these Terms, or your infringement of another person’s rights.
21. Events Beyond Our Reasonable Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, earthquake, epidemic, governmental action, labor disruption, utility or network failure, carrier delay, supply interruption, civil disorder, or similar events. This section does not affect rights that cannot be waived under applicable law.
22. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any rights you have under applicable consumer law, legal proceedings arising from these Terms or your use of the website or services will be brought in a state or federal court of competent jurisdiction located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
23. Severability, No Waiver, and Assignment
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of that provision or any other provision.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or operation of law, subject to applicable law.
24. Entire Agreement and Order of Precedence
These Terms, together with our Privacy Policy, Refund and Return Policy, Shipping Policy if applicable, Subscription Policy, and any product-, event-, membership-, or program-specific terms presented to you, constitute the agreement between you and us concerning the applicable transaction and use of our services.
If there is a conflict, the more specific terms disclosed for a product, event, membership, subscription, or program control for that subject, followed by these Terms and then the general website policies, unless applicable law requires otherwise.
25. Changes to These Terms
We may update these Terms from time to time by posting a revised version and changing the effective date. Changes apply prospectively from the effective date unless applicable law permits or requires otherwise. Your continued use of the website after revised Terms take effect constitutes acceptance of the revised Terms. Material changes to recurring plans will be handled in accordance with the applicable plan agreement and law.
